TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of www.vaporaxtechbd.com, related pages, and purchasing services provided by VaporaX Tech (“VaporaX Tech,” “we,” “us,” or “our”).

By visiting our website, creating an account, contacting us to place an order, or purchasing a product, you agree to these Terms. If you do not agree, please do not use our services.

  1. ELIGIBILITY AND AGE REQUIREMENT

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order.

You must be at least 18 years old to purchase lighters, ignition products, or any other age-restricted product from VaporaX Tech. You must not purchase such products for a minor.

We may request reasonable proof of age or identity and may cancel an order if the required verification is not provided.

  1. ABOUT VAPORAX TECH

VaporaX Tech is an independent retailer and importer of selected lighters, gadgets, accessories, and lifestyle products in Bangladesh.

Unless expressly stated otherwise, VaporaX Tech is not an authorised distributor, representative, sponsor, or affiliate of the third-party brands displayed on the website. Brand names, logos, and trademarks remain the property of their respective owners and are used only to identify genuine products offered for sale.

  1. PRODUCT INFORMATION

We make reasonable efforts to present product descriptions, specifications, designs, colours, prices, and photographs accurately. However:

• Colours may appear slightly different depending on the screen or lighting.

• Packaging, labels, accessories, manufacturing country, and minor design details may differ between international market batches.

• Product photographs may include display materials that are not included unless specifically stated.

• Products sold as assorted or selected variants are subject to the chosen variant and available stock.

Please review the product description and selected variant carefully before ordering.

  1. PRODUCT AUTHENTICITY AND WARRANTY

We source products through channels we consider reputable and aim to provide authentic products.

VaporaX Tech operates as an independent importer and reseller. A manufacturer’s local warranty may not be available for internationally sourced products unless warranty coverage is specifically stated on the product page, order confirmation, or invoice.

Any product-specific warranty applies only according to its stated terms. Damage caused by misuse, accidents, modification, improper storage, unauthorised repair, normal wear, or failure to follow manufacturer instructions is not covered.

  1. PRICES AND CHARGES

All prices are displayed in Bangladeshi Taka (BDT) unless stated otherwise.

The total payable amount may include:

• Product price;

• Delivery charge;

• Applicable taxes; and

• Any clearly disclosed additional charge.

Current standard delivery charges are generally ৳70 inside Dhaka and ৳120 outside Dhaka. Delivery charges may vary for remote locations, unusually large orders, special delivery arrangements, or promotional offers. The final applicable amount will be shown or communicated before order processing.

Prices and promotions may change without prior notice. Changes will not affect an order that we have already accepted, except where there is an obvious pricing, calculation, or technical error.

  1. ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase the selected products. An automated order confirmation only confirms that we have received your request.

An order is accepted when we confirm it for processing or dispatch. We may contact you by telephone, SMS, WhatsApp, Messenger, or email to verify the order.

We may refuse or cancel an order where:

• A product is unavailable;

• Payment cannot be verified;

• The price or product information contains an obvious error;

• The address is incomplete or outside our service area;

• We reasonably suspect fraud, misuse, a fake order, or an unlawful transaction;

• Age verification is required but not completed; or

• Courier or safety restrictions prevent delivery.

If we cancel a prepaid order, the eligible amount paid for the cancelled item will be refunded.

  1. PAYMENT

Available payment methods may include:

• Cash on Delivery for eligible orders;

• bKash;

• Nagad; and

• Bank transfer.

Cash on Delivery is generally available for eligible orders inside Dhaka. Orders outside Dhaka, customised orders, high-value orders, or orders with higher delivery risk may require an advance payment of up to 50% before processing or dispatch.

Any remaining balance must be paid through the method confirmed for the order.

Payments are treated as completed only after the funds have been verified. A payment screenshot alone does not confirm receipt.

Customers should pay only through payment details published on our website, official invoice, or verified VaporaX Tech communication. VaporaX Tech will never request your PIN, password, or one-time password.

  1. ORDER CANCELLATION

To request cancellation, contact us as soon as possible.

An order may be cancelled without delivery costs if it has not yet been processed, customised, packed for dispatch, or handed to the courier.

If a customer cancels after dispatch, refuses delivery without a valid product-related reason, remains unreachable, or provides an incorrect address, actual delivery and return charges may be deducted from any advance payment, where permitted by law.

Customised or personalised orders cannot normally be cancelled after production has started.

  1. SHIPPING AND DELIVERY

VaporaX Tech provides delivery across Bangladesh through third-party courier services.

Estimated delivery times are generally:

• Inside Dhaka: approximately 1–2 working days;

• Outside Dhaka: approximately 2–4 working days.

These are estimates, not guaranteed delivery dates. Delivery may be delayed by courier operations, weather, public holidays, strikes, political unrest, natural events, remote locations, incomplete addresses, unsuccessful contact attempts, or circumstances beyond our reasonable control.

Customers must provide a complete address and an active telephone number. VaporaX Tech is not responsible for delays caused by inaccurate or incomplete customer information.

Risk of loss normally passes to the customer or authorised recipient when the order is delivered. Please contact us promptly if tracking shows delivery but the package was not received.

  1. LIGHTER AND IGNITION-PRODUCT SAFETY

Lighters and ignition products are not toys and must be kept away from children.

By purchasing these products, you agree to:

• Use them only for lawful purposes;

• Follow all manufacturer instructions and warnings;

• Keep them away from children, excessive heat, open flames, and prolonged direct sunlight;

• Never puncture, crush, burn, dismantle, or improperly refill a product;

• Never leave an active flame unattended; and

• Store and dispose of products responsibly.

Do not use a lighter that is leaking, damaged, unusually hot, or malfunctioning. Do not send a used, leaking, fuelled, or damaged lighter through a courier unless VaporaX Tech has specifically confirmed a safe return procedure.

You are responsible for lawful and safe possession, storage, and use after delivery.

Please inspect the package and product promptly after delivery.

If you receive an incorrect, damaged, incomplete, or apparently defective product, contact us as soon as possible—preferably within 48 hours—with:

• Your order number;

• A clear description of the problem; and

• Relevant photographs or an unedited unboxing video, where available.

Evidence helps us investigate courier damage, packing errors, or product defects. However, nothing in this section removes any non-waivable rights available under applicable consumer law.

Do not ignite, refill, modify, repair, or continue using a product after discovering a defect. Depending on the circumstances and applicable law, we may offer troubleshooting, replacement, exchange, repair, store credit, or refund.

  1. RETURNS AND REFUNDS

Where a separate Refund Policy is published, that policy forms part of these Terms.

Change-of-mind returns are accepted only when approved by VaporaX Tech. To be eligible, a product must normally be unused, unlit, unfilled, unmodified, in resalable condition, and returned with its original packaging and included accessories.

The following are generally not eligible for change-of-mind return:

• Used, ignited, refilled, opened, or altered lighters;

• Customised or personalised products;

• Products damaged after delivery through misuse or improper storage;

• Clearance or final-sale products identified as non-returnable; and

• Items that cannot safely or legally be returned through a courier.

Approved refunds will be processed after the returned product has been received and inspected. Original delivery charges may not be refundable for change-of-mind returns. When the error is ours or the product was delivered defective, damaged, or incorrect, remedies will be provided according to the circumstances and applicable law.

Nothing in these Terms limits mandatory rights under Bangladesh consumer-protection law.

  1. ACCOUNTS AND CUSTOMER INFORMATION

You must provide current, complete, and accurate information when ordering or creating an account.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Notify us promptly if you believe your account has been accessed without authorisation.

We may suspend or close accounts connected with fraud, abusive conduct, repeated unjustified delivery refusals, false information, or violations of these Terms.

  1. PROHIBITED USE

You must not use our website or services to:

• Break any applicable law;

• Purchase an age-restricted product for a minor;

• Submit false, fraudulent, or misleading orders;

• Infringe intellectual-property or privacy rights;

• Upload viruses, malicious code, or harmful content;

• Interfere with website security or normal operation;

• Collect customer or website data without permission;

• Harass our staff, couriers, customers, or other persons; or

• Resell or use products for an unlawful or dangerous purpose.

We may restrict access, cancel orders, or take appropriate action where these rules are violated.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, the VaporaX Tech name, vXT identity, website layout, original text, graphics, photographs, videos, and promotional materials belong to VaporaX Tech or are used with permission.

You may not reproduce, distribute, modify, sell, or commercially exploit our original materials without prior written permission.

Third-party product names, logos, and trademarks belong to their respective owners.

  1. REVIEWS AND CUSTOMER CONTENT

If you submit a review, photograph, comment, testimonial, or other content, you confirm that it is truthful, lawful, and does not violate another person’s rights.

You grant VaporaX Tech a non-exclusive, royalty-free right to display and reproduce that content for store, customer-support, and marketing purposes. We may remove content that is unlawful, misleading, abusive, unrelated, or inappropriate.

  1. THIRD-PARTY SERVICES

Our website may use Shopify and other third-party services for hosting, checkout, analytics, communication, payment support, and delivery.

Third-party websites, payment providers, social platforms, and courier services may have their own terms and privacy practices. VaporaX Tech does not control those independent services, although this does not remove our responsibilities to customers under applicable law.

  1. PRIVACY

Our collection and use of personal information are governed by our Privacy Policy.

By placing an order, you authorise us to use the information reasonably required to confirm, process, deliver, support, prevent fraud relating to, and maintain records of your transaction.

We may send essential order communications by telephone, SMS, email, WhatsApp, or Messenger. Marketing communications may be declined or unsubscribed from where applicable.

  1. SERVICE AVAILABILITY

We aim to keep the website accurate, secure, and available. However, access may occasionally be interrupted for maintenance, updates, technical problems, security concerns, or circumstances beyond our control.

We do not guarantee that every feature will always be uninterrupted or error-free.

  1. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer rights or liability arising from fraud, wilful misconduct, or other liability that applicable law does not permit us to limit.

To the maximum extent permitted by law, VaporaX Tech will not be responsible for indirect, incidental, or consequential loss arising from unlawful use, customer misuse, failure to follow safety instructions, unauthorised modification, or events outside our reasonable control.

For claims that may lawfully be limited, our aggregate liability relating to a specific order will not exceed the amount paid for that order.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful use of our services, fraudulent activity, violation of these Terms, or infringement of another person’s rights.

  1. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Bangladesh.

If a concern arises, please contact us first so we can try to resolve it promptly and fairly. If the matter cannot be resolved, it may be submitted to the appropriate consumer-protection authority or a court of competent jurisdiction in Bangladesh.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect operational, legal, regulatory, safety, or service changes.

The revised version will be published on this website with an updated effective date. Changes will generally apply prospectively and will not reduce rights already attached to an accepted order unless required by law.

  1. SEVERABILITY AND ENTIRE AGREEMENT

If any part of these Terms is found unenforceable, the remaining provisions will continue to apply.

These Terms, together with the applicable product information, order confirmation, Privacy Policy, Refund Policy, and Shipping Policy, form the agreement between the customer and VaporaX Tech concerning the relevant purchase.
